What are the advantages of the collaborative divorce process?
The advantages to a client in the collaborative law process is that they maintain control over the settlement that ultimately happens. There are a lot of pieces to it where they are going to retain control or make decisions that they wouldn’t in a litigating case, but the bottom line is when you go into collaborative law, you sit around and you – the two of you, meaning the husband and wife – are coming up with solutions to their problems that work for them. If you go litigation at some point, you’re making decisions because of what you think the judge is going to do. Or if you can’t make decisions, you’re going to put it up on the desk and the judge is flat going to make them for you.
