The Collaborative Method
in Guardianship Cases

Guardianship - Collaborative Law Method:  The appointment of a party as a Guardian of a Person and/or Estate will always necessitate the filing of an Application and at least one appearance before the Court. The collaborative process is and has been very successful in creating settlement, between parties, that is interest based and preserves a future relationship between those parties.  Guardianship proceedings, like Family Law, often involve families or extended families and the complication that arise with these longstanding relationships.  In most cased the parties have an interest in preserving the family relationship,  or have no choice other than trying to preserve the relationships they have with the other parties.  The option to preserve relationships and create a solution to a case that is in line with all the parties’ interests can create an “added benefit” to a case that may not be obtainable in a litigated case.  After the Collaborative Law Agreement is signed by all parties, 100 % of the effort from all the professionals and all the parties is spent obtaining a settlement and agreement between the parties that meet each parties own interests to the extent possible with in the agreement. 

There are many considerations before filing a guardianship action and during the pendency of a guardianship case that are unique to this type of case.  There are several areas of the case that must be investigated, what type of guardianship needed, level of protection needed to protect the proposed ward, need of additional filings to recover property or preserve property is but a few.  Using the ability to collaborate between the parties provides for a solution to the guardianship proceeding that is inclusive of all the parties’ knowledge and input, thereby creating a more comprehensive Order out of the Guardianship case for the benefit of the Ward.
